What can I do if someone has registered a domain name using my brand? #

You can file a domain name dispute under the Uniform Domain Name Dispute Resolution Policy (UDRP) before WIPO for generic top-level domains (.com, .net, .org, etc.) or under the IN Domain Name Dispute Resolution Policy (INDRP) before the NIXI for .in domains. You need to show that the domain name is identical or confusingly similar to your trademark, that the registrant has no legitimate interest in the domain, and that it was registered and is being used in bad faith. These proceedings are faster and less expensive than court litigation.

Should I register domain names defensively? #

Yes. Defensive domain registration is a cost-effective way to prevent cybersquatting and brand misuse. We recommend registering your brand name across key extensions (.com, .in, .co.in, and relevant new gTLDs), common misspellings, and variations. The cost of registration is significantly lower than the cost of recovering a domain through dispute proceedings.

How do I protect my brand from misuse on e-commerce platforms and social media? #

Most major platforms have brand protection and IP complaint mechanisms. We assist clients in enrolling in platform-specific brand protection programmes, filing IP infringement reports, and pursuing takedowns of counterfeit listings, impersonation accounts, and infringing content. For systematic or large-scale infringement, we pursue court proceedings including John Doe orders that bind platforms and intermediaries.
